Terms & Conditions

Last updated: 26 October 2026

1. Who you are contracting with

Forged Element Analysis is operated and sold by Shaun Dale ("the seller", "we", "us"), an individual seller based in Australia. By creating an account, starting a trial, or purchasing a license, you enter into a contract with Shaun Dale. By continuing to use the service you agree to these terms.

2. The product

Forged Element Analysis is a 3D finite element analysis (FEA) workbench for linear static structural analysis. It runs in your web browser and as a downloadable desktop application. New accounts receive a 7-day free trial of the full product; after the trial, continued use requires a one-time license purchase.

3. License

We grant you a limited, non-exclusive, non-transferable right to use Forged Element Analysis for your own engineering work. You must not reverse engineer the software, resell or redistribute it, share your account credentials, or circumvent the trial or license controls. You are responsible for activity under your account and for keeping your credentials confidential.

4. Acceptable use

You must not misuse the service. This includes unlawful use, fraud or spam, infringing intellectual property rights, and interfering with the security or operation of the service (including introducing malware, probing, or scraping).

5. Engineering responsibility

Analysis results depend on the geometry, mesh, materials, supports and loads you provide. You are responsible for verifying that results are suitable for your application. Forged Element Analysis is a tool to assist qualified engineering judgement, not a substitute for it.

6. Intellectual property

The seller retains all ownership of the service and its intellectual property, including the software, documentation and branding. Models you import and results you generate remain yours.

7. Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms.

8. Service level

We do not guarantee uninterrupted or error-free performance. The desktop application is designed to run offline on your own computer; the web service may be unavailable from time to time for maintenance or reasons beyond our control.

9. Warranties and liability

To the fullest extent permitted by law, the service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill). Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for fraud, death or personal injury, or your rights under Australian Consumer Law.

10. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. If your access ends, your license to use the service ends with it.

11. Governing law

These terms are governed by the laws of Western Australia, and the courts of Western Australia have exclusive jurisdiction over disputes, except where mandatory consumer law provides otherwise.

12. Contact

Questions about these terms can be sent via the support contact shown on forgefea.com. For payment, billing and refund inquiries, contact Paddle at paddle.net.
